Here Are All 205 "Economically Significant" Rules in the Spring 2015 Unified Agenda of Federal Regulations

The Spring 2015 Unified Agenda of Federal Deregulatory and Regulatory Actions was released by the Obama administration just before Memorial Day weekend.

It’s less of a “memorial” to the American idea of liberty than a monument to red tape.

Many recognize that the already obscure (but eye-opening) document tends to be released just before holiday weekends, as if to escape notice.

The Agenda is a twice-annual cross-section of the regulatory state. It’s a pipeline showing the flow of rules and regulations at the "Active" (pre-rule, proposed and final rule states), "Completed" and "Long-term" phases.

The total number of rules in the Agenda is 3,260; that consists of 2,323 Active, 477 Completed and 460 Long-term.

Items featured or prioritized in the Agenda vary over the years, creating confusion and making it hard to compare Agendas. For example, the Obama administration recently to de-emphasize some "Long-term" rules, when those are actually very important to know about for planning purposes.

Often the rules listed are holdovers from prior years. Nonetheless, since over 3,500 rules are finalized each year (there were 3,554 in 2014); this just tells us that many rules never appear in the Agenda at all.

Except for the long-term category, there are fewer rules compared to last spring; but the new Agenda contains one of the costliest rules, the national ozone standard from the Environmental Protection Agency among much else.

A portion of these rules, like the ozone standard, are officially considered “economically significant” which means they have economic effects (usually costs rather than savings) of at least $100 million every year.

Economically significant leaves out those matters that agencies prefer not to recognize as such.

Incredibly, EPA doesn’t list its sweeping new Clean Water Rule on nationwide permitting on private property as “economically significant” (merely “other significant”). With over a million comments received at the agency, comments that it perhaps illegally self-induced, it’s hard to trust bureaucracies’ judgment with respect to the remaining 3,000-plus rules not being economically significant.

Of course, many other rules are economically significant in fact, but don’t get labeled that way by the government, including the Federal Communications Commission’s net neutrality rules, and proposals to require quiet electric vehicles to make noise (the same expensive vehicles that had to be subsidized into existence). For still another example, one might think the 13 Department of Justice rules relating to firearms might need underscoring.

Alongside failing to acknowledge some costly rules, agencies are not legally bound to limit themselves only to what they present in their bi-annual roundups.

Therefore unfortunately we can’t put much stock in the “economically significant” designation as far as capturing the most burdensome agency actions—a shame since it’s about all we have.

In any event, while the total rule count each year tops 3,500, those in the “economically significant” category over the past decade’ fall Unified Agenda releases have ranged from as low as 127 to as high as 224.

Here we’ll put a face on the new batch of "economically significant" rules: There was a total of 3,260 rules in the Spring 2015 Agenda as we’ve noted. Of these, 205 of them designated as economically significant.

Of these, 140 are “active,” 25 recently “completed,” and 40 “long-term.” The full list appears down below the break.

Herein you may find such delights as:

  • The Department of Energy's drive to regulate everything that uses energy (from vending machines to ice makers).
  • The Department of Health and Human services requirements for labeling serving sizes of foods; labels on pet food; calorie count postings for vending machines and restaurants; rules for school lunch contents.
  • The Environmental Protection Agency's multipronged campaign against fossil energy—and even home wood fires.
  • Treasury Department rules implementing parts of the Dodd-Frank financial reform law.

Below the break, the Spring 2015 “economically significant” rules inventory is broken down by department or agency, and by stage of completion. (And if you’re doing deep dives, the “Regulation Identifier Number” appears at the end of each entry below.)

Policymakers need to start taking a closer look at the federal government’s “other significant” category, elements of which fall through the cracks. We’ll examine those later.
