1. ENVIRONMENT

CEI files a lawsuit to force NASA to turn over documents relating to ClimateGate.

CEI Expert Available to Comment: Senior Fellow Chris Horner on why it’s important that NASA release the documents.

“What we’ve got is the third leg of the stool here, which is the U.S.-led, NASA-run effort to defend what proved to be indefensible, and that was a manufactured record of aberrant warming. We assume that we will also see through these e-mails, as we’ve seen through others, organized efforts to subvert transparency laws like FOIA.”

2. IMMIGRATION

The Department of Justice may sue over Arizona’s immigration law.

CEI Expert Available to Comment: Policy Analyst Alex Nowrasteh on the economist costs of the new law.

“There’s a clause at the end of Section 2 [of the bill] that gives any legal resident of Arizona the ability to sue any official or agency of that state that implements a policy that limits or restricts the enforcement of immigration laws. As Arizona will likely soon discover, there are few things more expensive than excessive court costs and legal fees arising from frivolous lawsuits. Proponents of the law play down or entirely ignore these sections, assuming they’ve even read the law’s whole text.  We should judge laws by their effect, not by their intentions. As the road to hell is paved with good intentions, so is the road to economic ruin.”

3. LEGAL

The Senate is expected to vote on repealing “Don’t Ask, Don’t Tell” soon.

CEI Expert Available to Comment: Senior Counsel Hans Bader on why we will benefit from a repeal.

“It makes sense to end DADT, which both gets rid of qualified gay people who want to serve, and lets others escape deployment for combat by suddenly revealing their gayness, or pretending to be gay. By contrast, formally adding sexual orientation to antidiscrimination/diversity policies can lead to an expansion of nonsense such as politicized ‘diversity training.’”
