Biden Veto of Bipartisan Congressional Resolution to Withdraw WOTUS Rule Highlights Administration’s Environmental Extremism

President Joe Biden vetoed a bipartisan resolution passed by Congress under the Congressional Review Act (CRA) that would have rescinded EPA and the U.S. Army Corps of Engineers’ Waters of the United States (WOTUS) rule. The rule will vastly expand the agencies’ regulatory authority.

Deputy Director of CEI’s Center for Energy and Environment Daren Bakst said:

“President Biden had a chance to do the right thing by signing the resolution into law. He could have respected property owners, including our nation’s farmers and ranchers, reduced regulatory uncertainty, and honored the wishes of Congress, which gave the EPA and Corps the power to regulate waters in the first place. 

“But instead he chose to defend a rule that Congress, in a bipartisan manner, soundly rejected. This action demonstrates the extremism rampant in the administration.

“The administration still has the opportunity to at least do something right. The EPA and Corps should withdraw the rule, wait for the Supreme Court to issue its opinion in Sackett v. EPA that is expected to clarify the regulated waters issue, and then go back to the rulemaking drawing board.”
