Washington’s Thanksgiving Turkeys: Here’s Your Chance to Fill Up on the White House’s 218 Economically Significant Rules

The president will pardon a couple turkeys again this year for Thanksgiving.

The birds will take a carbon-intensive cross country flight from San Francisco International Airport to meet the POTUS.

For us, there is no reprieve coming from Washington’s big-government ways.

In fact, you could stuff a lot of Thanksgiving turkeys with the red tape and paperwork pouring out of Washington.

There are thousands of rules and regulations every year, in every administration.

The Fall 2015 Unified Agenda of Federal Regulatory and Deregulatory Actions (mostly regulatory), released just before the Holiday break,  reports on 3,297 rules and regulations at the “active,” “completed” and “long-term” stages of the regulatory pipeline, many of them holdovers from earlier volumes.

Over 3,500 rules get issued each year. A portion of these rules, though, are “economically significant” ones with impacts (usually costs rather than liberalizations) of at least $100 million every year.

This fall there are 218 of these big rules in the Fall Unified Agenda: 149 active, 36 recently completed, and 33 long-term.

Items that get featured or prioritized in the Agenda vary, creating confusion and making it hard to comparisons across the years difficult. For example, the Obama administration recently told agencies not to talk so much anymore about their "Long-term" rules, when those are actually very important to know about. Also, agencies are not bound to limit their activities to what they present in the Agenda (but should be).

The full list of the 218 economically significant rules appears down below the break, with plenty “turkeys” in the lineup. But first, here’s a sampling:

  • The Department of Energy continues its drive to regulate anything and everything that uses energy, even in our ordinary households, including dishwashers, hearth products, fans, computers, and battery backups. There are even energy efficiency rules for pre-fab housing. And for the little stand-up heaters that have become popular.
  • The Department of Health and Human Services’ regulation of food labeling (and even labeling of pet food), portion size regulations for things like breath mints, rules on sanitary transport of food, regulation of home health-service providers, and rules for e-cigarettes. A recent debate was over calorie count postings for vending machines and restaurants.
  • The Department of Agriculture’s rules for school lunch contents.
  • The Department of Housing and Urban Development’s “Instituting Smoke-Free Public Housing.”
  • The Department of the Interior’s interference with Arctic drilling and resource access
  • The Transportation Security Administration’s “Passenger Screening Using Advanced Imaging Technology.”
  • Department of Labor rules on paid sick leave for businesses that contract with the government, and conflict of interest rules affecting investment advisors.
  • Department of Transportation “Rear Seat Belt Reminder System,” speed-control rules for certain heavy vehicles, proposed rules on “vehicle-to-vehicle” communication, and commercial hours-of-service and driver-training mandates.
  • The Environmental Protection Agency's campaign against ordinary wood fires and continued crusade all fossil energy of all types.
  • Rules implementing parts of the Dodd-Frank financial reform law and Obamacare.

Many rules not among the 218 the government self-selects are significant too, of course. Among these have been the Federal Communications Commission’s net neutrality rules, and proposals to have silent subsidized-into-existence electric vehicles make noise.
