Another Legal Double-Bind: Comcast
Public Knowledge just dug up some dirt on Comcast. Comcast has been fighting charges of violating net neutrality principles at the FCC by claiming that the FCC lacks the authority to regulate such issues. But in another series of suits in state courts, Comcast claimed that the states were preempted by Congress’s delegation of internet regulation to the FCC. This puts Comcast into a double bind, much like the one that my colleague Ryan Radia reported yesterday that Google faced. Once again, multiple sovereign jurisdictions are the problem – though in this case, it’s the fault of our country’s federal system.
