Sugarplums or Lumps of Coal? The White House’s 140 Economically Significant Rules

There are thousands of federal rules and regulations every year, in every administration.

We got a reprieve from Washington’s big government ways in 2017.

In the White House’s new Regulatory Plan and Unified Agenda of Federal Regulatory and Deregulatory Actions, the administration touts success in surpassing President Trump’s goal to eliminate two regulations for every one adopted.

In fact, the administration says it got rid of 21 significant regulations for every one significant regulation adopted, as we discussed here. In total, there were 67 rules eliminated, and three added.

But not everything counts: 

EO 13771 Regulatory Actions. EO 13771 regulatory actions are defined as those final actions that both impose costs greater than zero and qualify as “significant” under Section 3(f) of EO 12866 (see M-17-21, Q2). Accordingly, the regulatory actions listed in this table represent a subset of an agency’s total regulatory actions.

Furthermore, independent agencies and their rules are not part of Trump’s rollback, apart from the extent to which they elect to join in. 

The most costly rules in the Agenda are classified as “economically significant,” which loosely means they have $100 million in effects.

These are also closely related to the “significant” rules which fall under Trump’s E.O. 13771.

The Fall 2017 Unified Agenda of Federal Regulatory and Deregulatory Actions reports on 3,209 rules and regulations at the “active,” “completed,” and “long-term” stages of the regulatory pipeline, many of them holdovers from earlier volumes.

Among these, there were 140 economically significant rules: 71 active, 21 completed, and 48 long-term. The overall flow of economically significant rules in Trump’s Fall Unified Agenda is 27 percent lower than Obama’s was in 2016, when there were 193 entries.

But Trump’s figures also contain numerous “rules” that are withdrawals or holds of pre-existing orders, so the deregulation behind the scenes may be understated in that sense. And one must write a new rule to get rid of an existing one.

Items that get featured or prioritized in the Agenda vary, creating confusion and making comparisons across the years difficult. For example, the Obama administration had told agencies to reconsider listing their “Long-term” rules. And agencies are not bound by law to limit their activities to what they present in the Agenda (but they should be).
