Setback for EPA in federal court

Politico's Morning Energy reports on CEI's motion to compel the release of emails that a White House official stored on a private email account. 

The Competitive Enterprise Institute filed a motion Monday to compel the release of emails from White House Science Adviser John Holdren that are stored on a secondary, non-governmental account. In early July, a federal appeals court ruled Holdren’s communications might still be covered the Freedom of Information Act even if they aren’t on government-controlled servers. The Obama administration opted not to fight that ruling but has yet to produce any responsive documents, according to CEI. The motion notes relevant communications “need to be turned over to agency FOIA staff soon” because Holdren will depart with the Obama administration and the docs could “become beyond the reach of this court.”
