Over the last century, federal courts have regularly failed to preserve our Constitution’s limits on government powers, and instead acquiesced to Congress unlawfully expanding its authority. The public interest litigation program of the Competitive Enterprise Institute acts to change that.
Earlier this year, in a Texas district court, CEI successfully argued that the criminal penalties in federal law for home distilling are unconstitutional. Unfortunately, the Department of Justice immediately appealed the case.

Dan Greenberg is the general counsel for the Competitive Enterprise Institute. From 2017-2021, he served as senior policy advisor at the U.S. Department of Labor. Prior to that he served as an Arkansas state legislator. Dan holds degrees from Brown University, Bowling Green State University, and UALR’s Bowen School of Law.
Devin Watkins is an attorney at the Competitive Enterprise Institute. Previously, he worked at the Institute for Justice and the Cato Institute, where he worked on a variety of Supreme Court cases, including a brief cited by the Court. Devin holds a Juris Doctor cum laude from George Mason University’s Antonin Scalia Law School.
