The past two presidential administrations offered two different approaches to implementing effective regulation.

Since President Ronald Reagan instituted modern White House regulatory oversight in 1981, cost-benefit analysis in the Office of Information and Regulatory Affairs has been the most prominent tool for restraining agency activism. In 2021, the Trump administration supplemented it with a “regulatory budget,” which required agencies to set priorities by prohibiting them from imposing new regulatory costs without reducing other expenditures.

The Biden administration repealed the regulatory budget requirements, and in April 2023, it modified cost-benefit analysis itself.
