ABOUT THE HEARING:
This hearing will build on the previous guidance hearing held September 23, 2015 by providing the perspectives of non-governmental witnesses with expertise in administrative law, institutional experience in overseeing and coordinating guidance processes, and familiarity with how guidance fits into the larger regulatory apparatus. Topics for the hearing will include discussion of agency use of regulatory guidance cross-government; ways in which agencies use guidance in communicating with the public; current and former Administration efforts to ensure that this guidance is issued appropriately and the success of these efforts; and potential legislative solutions and safeguards.
