CEI v. EPA – No. 15-215

 

The Competitive Enterprise Institute has yet again been forced to sue the Environmental Protection Agency to obtain public records under the Freedom of Information Act (FOIA) related to Administrator Gina McCarthy. Yesterday, CEI filed suit in the federal district court of the District of Columbia demanding the release of two specific email conversations initiated by Ms. McCarthy about her use of text messages to correspond with senior policy aides at the EPA, and potentially other unknown recipients.

In a February 8, 2017 decision, the judge agreed with CEI that we exhausted administrative but accepted the agency’s privilege claims, ruling in favor of the EPA and closing the case. Read the order here.
