A group of individuals and small business owners in six states filed suit on May 2, 2013 against the federal government over an IRS rule imposed under the Affordable Care Act (Obamacare).  This is an unauthorized rule that ignores the choice that Congress gave the states to each decide whether to participate in the Obamacare insurance exchange program.  As a result of this rule, the plaintiffs will be subject to exorbitant fines, pressure to cut back their employees’ hours, and restrictions on their insurance choices. 

This document is an amicus brief in support of the plaintiffs
