Court dismisses meritless FTC case, allows Microsoft-Activision merger to go ahead for now

A federal judge ruled Tuesday that Microsoft could proceed with its acquisition of Activision-Blizzard, despite the Federal Trade Commission’s (FTC) efforts to stop the merger.
Director of CEI’s Center for Technology and Innovation Jessica Melugin said:
“This decision is no surprise because of the meritless nature of the FTC’s case, but hopefully it will be a corrective rebuke to regulators. Whatever academic theories may be in vogue among unelected, appointed officials, the facts still matter in Article III courts. Consumer welfare remains the legal precedent – maybe that idea should be extended to not wasting taxpayer money bringing senseless lawsuits.”
