EARN IT Act Would Have Dangerous Unintended Consequences for Consumers

The Senate Judiciary Committee is meeting today for a markup for S. 1207, the EARN IT Act of 2023.
Director of CEI’s Center for Technology and Innovation Jessica Melugin argues the EARN IT Act would have dangerous unintended consequences:
“No one can argue with the noble cause of combating child sexual content online, but this bill has dangerous unintended consequences. Namely, it disincentivizes platforms to offer encryption to its users. The Twitter Files showed how helpful encrypted messaging would have been to stop government spying and led Elon Musk to say he plans to offer the service in the future. That won’t happen if EARN IT makes that too much of a liability risk.”
