Supreme Court Nominee Alito Good News

Washington, D.C., October 31, 2005—The President's nomination of Third Circuit Judge Sam Alito to serve on the Supreme Court is good news.<?xml:namespace prefix = o ns = “urn:schemas-microsoft-com:office:office” />

Judge Alito has an extensive legal record, readily available for examination and review. In fact, Alito has issued landmark decisions upholding the free speech rights and freedom of association of business trade associations (Pfizer v. Giles (1995)) and commercial free-speech rights (Pitt News v. Pappert (2004)).  His rulings have also shown a grasp of the regulatory and legal challenges facing business and an appreciation of the value of free markets.  He has upheld freedom of contract by enforcing contracts as written, including choice-of-law and arbitration provisions.

The vast majority of the decisions authored by Judge Alito, including his most important decisions, have been unanimous decisions, joined by his colleagues of both political parties. Judge Alito is well within the judicial mainstream. He has experience and expertise in the kinds of cases that the Supreme Court handles and, by any measure, is well-qualified to sit on the Supreme Court.
