332 Costliest Rules in the Fall 2022 Unified Agenda of Federal Regulations

Every year, federal agencies issue thousands of rules, regulations, and guidance documents, compared to a relative handful of laws passed by Congress. After a partial regulatory reprieve during the Trump era of 2017 to 2020, the Biden administration is sending rulemaking back to Obama-era heights and beyond.  

The Biden White House’s new Fall 2022 Regulatory Plan and Unified Agenda of Federal Regulatory and Deregulatory Actions just appeared (detailed here). Since the early 1980s—in the wake of the Paperwork Reduction Act and an extension to regulation by President Reagan—the Agenda has provided a twice-yearly look at a selection of federal agency regulatory priorities.

As it happens, Biden’s January 4, 2023 release was the latest ever apart from the spring 2012 Agenda that never appeared at all under Obama. (We covered Biden’s spring 2022 edition here.) Biden’s lapse is emblematic of a broader deterioration in regulatory disclosure in this administration.

Under Biden, the White House Office of Management and Budget (OMB) has been transformed from watchdog of regulation into a promoter of it. The change was announced along with the abandonment of the Trump era one-in, two-out stance toward regulation. Oversight is replaced with “Modernization,” which translates into the expansion of government, unimpeded by OMB.

Overall, and reviewed earlier this week, the Agenda reveals that 69 departments, agencies, and commissions have 3,690 rules in the pipeline at the “Active,” “Completed,” and “Long-term” stages.

The costliest among the 1,160 “significant rules” in the Agenda get further classified as “economically significant.” That loosely means they sport at least $100 million in annual effect, either adding costs or reducing them (usually adding them). There are 332 of these “economically significant” entries at the Active (244 of them), Recently completed (53) and Long-term (35) stages, as seen below.  

Comparatively, there were 261 economically significant rules in Trump’s final Agenda in 2020. Trump’s highest count, that tally was amplified by the necessity of writing a rule to eliminate a rule in pursuit of the then-pertinent the in/out goal. Reflecting that, 36 of Trump’s economically significant rules were classified “Deregulatory,” a designation the White House has now eliminated.

Also inflating Trump’s final Agenda December 2020 were rules addressing the COVID-19 crisis, such as over 20 significant ones issued by the Small Business Administration regarding operations of the Paycheck Protection Program.

Biden’s executive actions continue in 2023, notably a contemplation of banning gas stoves, heralding further regulatory activism. The recent infrastructure, inflation, and “innovation” legislative packages can be expected to make their regulatory effects further known in upcoming Agendas.
