Time’s up: Why housing permits need a shot clock

Governments routinely impose deadlines on businesses and individuals. Miss a tax filing deadline or fail to renew a license on time, and you face the consequences. Yet when governments review housing applications, they are typically under no comparable obligation to make timely decisions.

Housing developers spend months or years waiting for permits to be approved while financing costs accumulate and projects become less viable. As policymakers search for ways to reduce unnecessary delays in permitting, one reform has begun attracting increased attention: statutory shot clocks.

In this context, statutory shot clocks are laws that require government agencies to decide on housing permit applications within a fixed period. Shot clocks can range from soft deadlines with limited enforcement to procedural systems requiring timely decisions subject to legal remedies to strict regimes in which missed deadlines result in automatic approval.

Several states have already adopted statutory shot clocks for housing administration. California’s AB 1308 requires local governments to complete certain residential building inspections within 10 business days, while Florida’s 2024 permitting reforms require local governments to act on many building permit applications within fixed statutory deadlines. Although their enforcement mechanisms differ, both laws seek to reduce unnecessary administrative delay.

The logic behind shot clocks rests on basic incentives. When approvals are delayed, agencies do not bear significant costs for delay. However, developers continue paying interest on loans, holding land, and absorbing uncertainty about whether a project will proceed. As I recently discussed, this results in a permitting system where delays raise costs, discourage investment, and leave communities waiting longer for new housing.

Shot clocks aim to address this by imposing firm deadlines on decision-making that require permitting agencies to either approve or deny applications within a predictable window while leaving substantive review standards unchanged. In theory, this ensures that time itself becomes a binding constraint that mitigates delay-related costs and uncertainty.

However, translating this theory into observable outcomes depends on how deadlines for permitting agencies are enforced. Some shot clocks impose only reporting requirements or procedural targets, whereas others attach meaningful consequences to delay, such as financial penalties, judicial remedies, or automatic approval if an agency fails to act.

When deadlines are decoupled from real accountability, they function more as procedural guidelines than binding constraints. By contrast, when deadlines are coupled with meaningful accountability, they transform permitting timelines from aspirational targets into binding commitments that reshape administrative behavior.

A well-designed shot clock must also avoid the inverse risk: a denial by deadline. If a deadline is too restrictive and does not allow for technical complexity, agencies may resort to preemptive denials to avoid the risk of automatic approval. As with any institutional reform, the effectiveness of a shot clock depends on whether it improves incentives without creating larger distortions elsewhere in the permitting process.

While the evidence base on permitting shot clocks is limited, the broader literature on administrative deadlines and bureaucratic performance provides insight into how time constraints affect agency behavior.

One relevant strand comes from the judicial administration literature. Research on US federal courts finds that time-based performance incentives and deadline structures can significantly affect processing speed, with stronger time expectations associated with faster case resolution. These findings suggest that even in highly formalized legal institutions, deadlines influence how administrators allocate attention and prioritize work.

A related study concluded that statutory deadlines in administrative rulemaking increase the likelihood that agencies complete actions within expected timeframes and improve the predictability of completion timing. Rather than eliminating discretion, deadlines appear to structure the timing of agency decisions, which reduces variation in processing duration across comparable tasks.

Finally, research on administrative delay highlights how backlog dynamics can become self-reinforcing. Administrative delay is not merely a passive consequence of workload, but it can contribute to further delays by degrading organizational performance and increasing processing congestion. In this sense, delay can compound over time when agencies lack external constraints on timeliness.

These findings in the public administration literature suggest that bureaucratic systems tend to respond to time constraints by reallocating effort toward meeting deadlines, improving predictability, and reducing delays, while unconstrained systems exhibit greater variance and persistence in processing times.

It follows that statutory shot clocks in housing permitting would operate under similar mechanisms by forcing agencies to prioritize pending applications, reducing the accumulation of indefinite delay, and increasing predictability for applicants making investment decisions.

This conclusion is strengthened by the well-established finding that permitting delays increase financing costs and uncertainty. If delay imposes real costs, constraining it through enforceable timelines should improve outcomes through the same incentive channel.

In summation, statutory shot clocks are a promising reform for improving the speed and predictability of housing permitting. They align agency incentives with timely decision-making while preserving existing review standards.

That being said, the effectiveness of strict timelines may be constrained in smaller municipalities that lack sufficient staff to process applications efficiently. In those contexts, the challenge becomes how to preserve the discipline of deadlines while expanding the system’s ability to meet them, which raises questions best left to a separate analysis.
