Amicus Curiae: Adams v. USAA
Instead of protecting the interests of their clients, class counsel forum-shopped the case to a jurisdiction that was more likely to sign off on the settlement and their attorneys’ fees. It was appropriate and well within the district court’s authority to sanction class counsel for abusing the judicial process and prejudicing their clients in this way. CEI filed the brief following appointment as amicus by the Eighth Circuit because there was no appellee to defend the district court’s decision.
