AI Executive Order preempts state regulation, promotes US competitiveness: CEI analysis

President Trump on Dec. 11 signed an executive order to preempt states from regulating artificial intelligence and establishing a federal framework focused on child safety, anti-censorship, and copyright protection. Jessica Melugin, director of CEI’s Center for Technology and Innovation says AI is clearly within federal jurisdiction over interstate commerce and a sensible federal framework essential for US competitiveness:

“We need federal preemption of most state AI regulation in order to successfully compete with China in the race to lead AI. Much of AI commercial activity is clearly interstate commerce. A patchwork of 50 different regulatory regimes places our entrepreneurs and firms at an unfair advantage globally. Congress should codify this approach.”
