Melugin: Preempting state-level AI regulation shouldn’t come at the expense of  speech rights and parental responsibility

The House Energy and Commerce Committee’s Subcommittee on Commerce, Manufacturing, and Trade will hold a hearing this morning on several bills related to technology, including the Kids Online Safety Act (KOSA). Reports suggest the committee is considering a plan to put KOSA and state AI preemption in the same legislation.

Director of CEI’s Center for Technology and Innovation Jessica Melugin believes that while preempting a patchwork of state AI laws is critical, it should not come at the expense of speech rights and parental prerogatives.

“Well-crafted preemption of some state AI regulation is critical to US leadership around the globe and to ensure the promise of this technology. But it shouldn’t come at the expense of Americans’ constitutional right to speech, their ability to preserve their privacy online, or the primacy of parental control in keeping kids safe online,” said Melugin.
