On behalf of the Competitive Enterprise Institute, Mario Loyola (one of its fellows) and Richard A. Epstein (filed an amicus brief in the appeal that attacked the novel use of the public-nuisance theory to create such an outlandish result, in which the least relevant party is hit with a disproportionate share of damages.
