Amicus Curiae Submission on Consumer Choice and Energy Regulation
The Competitive Enterprise Institute requests that the Court grant certiorari and reverse the D.C. Circuit’s decision upholding the Department of Energy’s energy efficiency standards. The court’s interpretation of the Energy Policy and Conservation Act misapplies the statutory text and improperly defers to agency interpretation. If left standing, the decision will undermine consumer choice and exceed the limits Congress placed on agency authority.
