CEI v. EPA – Complaint for Declaratory and Injunctive Relief and Writ of Mandamus
The Competitive Enterprise Institute filed a lawsuit against the Environmental Protection Agency (EPA) to compel the agency to produce text messages sent or received by EPA official Gina McCarthy on her government-issued device on specific dates, as required by the Freedom of Information Act (FOIA). To date, the EPA has not provided any records in response to this FOIA request, and this complaint seeks to prevent further destruction of such records, as has occurred with EPA records in the past.
